We are finally at the stage where we are preparing a demand to send to the insurance company. This is a detailed summary sent to the insurance company outlining what happened. Who is at fault? Your injuries and medical care and then formally demanding money. The demand for money is supported by all evidence and documentation we've gathered throughout your case. We usually provide the insurance company at least two weeks to respond. After the demand is submitted, the insurance company reviews the file and response. They may make an initial offer. They may request clarification or request additional records. They may also dispute certain aspects of the claim. Negotiation is typically a process, not a single conversation. When an offer is made, we review it carefully and we discuss it with you. We provide our expert opinion as to whether it is a good offer or a bad offer, based on what has happened to you. We will also discuss options. You are never pressured into a decision. Our role is to advise based on our experience and the strength of your case. If negotiations result in a fair resolution, we proceed to settlement. If they do not. Litigation becomes the next consideration. Litigation means filing your lawsuit. In the next video, we'll explain what happens when a case resolves, whether that's through settlement or through the court system.
